INSTRUÇÃO NORMATIVA Nº 10, DE 17 DE MARÇO DE 2023

Em atendimento ao parágrafo único do art. 4º da Lei nº 9.966, de 28 de abril de 2000, o Ibama divulga lista atualizada de classificação das substâncias nocivas ou perigosas de acordo com o risco produzido quando descarregadas na água baseada, com mesmo rigor e completude, na listagem do Código Internacional de Produtos Químicos a Granel - IBC Code adotada pelo Anexo II da Convenção Internacional para a Prevenção da Poluição Causada por Navios - Marpol 73/78 atualizada pela emenda MEPC.318(74) do Comitê de Proteção do Meio Ambiente Marinho da Organização Marítima Internacional (IMO), promulgada pelo Decreto nº 10.984, de 7 de março de 2022.

O PRESIDENTE DO INSTITUTO BRASILEIRO DO MEIO AMBIENTE E DOS RECURSOS NATURAIS RENOVÁVEIS - IBAMA, nomeado pela Portaria nº 1.779/Casa Civil, publicada no DOU de 24 de fevereiro de 2023, no uso das atribuições que lhe conferem o art. 15, inciso V do Anexo I do Decreto nº 11.095, de 13 de Junho de 2022, que aprovou a Estrutura Regimental do Ibama, publicado no DOU de 14 de junho de 2022, e o art. 195 do Anexo I da Portaria Ibama nº 92, de 14 de setembro de 2022, publicada no D.O.U do dia 16 de setembro de 2022, o parágrafo único do art. 4º da Lei nº 9.966, de 28 de abril de 2000 e considerando o constante no Processo nº 02001.003018/2021-11, resolve:

Art. 1º Em atendimento ao parágrafo único do art. 4º da Lei nº 9.966, de 28 de abril de 2000, divulgar lista atualizada de classificação das substâncias nocivas ou perigosas de acordo com o risco produzido quando descarregadas na água baseada, com mesmo rigor e completude, na listagem do Código Internacional de Produtos Químicos a Granel - IBC Code adotada pelo Anexo II da Convenção Internacional para a Prevenção da Poluição Causada por Navios - Marpol 73/78 atualizada pela emenda MEPC.318(74) do Comitê de Proteção do Meio Ambiente Marinho da Organização Marítima Internacional (IMO), promulgada pelo Decreto nº 10.984, de 7 de março de 2022.

Art. 2º São consideradas substâncias nocivas ou perigosas classificadas:

I - na categoria A de que trata o inciso I do artigo 4º da Lei nº 9.966, de 28 de abril de 2000, aquelas classificadas na categoria X do Capítulo 17 do Código Internacional de Produtos Químicos a Granel - IBC Code e suas atualizações;

II - na categoria B de que trata o inciso II do artigo 4º da Lei nº 9.966, de 28 de abril de 2000, aquelas classificadas na categoria Y do Capítulo 17 do Código Internacional de Produtos Químicos a Granel - IBC Code e suas atualizações;

III - na categoria D de que trata o inciso IV do artigo 4º da Lei nº 9.966, de 28 de abril de 2000, aquelas classificadas na categoria Z do Capítulo 17 do Código Internacional de Produtos Químicos a Granel - IBC Code e suas atualizações.

Parágrafo único. Considerando o princípio da precaução e que as definições das categorias B e C de que tratam o incisos II e III do artigo 4º da Lei nº 9.966, de 28 de abril de 2000 e a definição da categoria Y do Capítulo 17 do Código Internacional de Produtos Químicos a Granel - IBC Code tratam de substâncias de risco médio ou moderado para a saúde humana ou para o meio ambiente, todas as substâncias que poderiam ser classificadas na categoria C, ficam classificadas na categoria B.

Art. 3º As substâncias classificadas na categoria OS (Outras Substâncias) do Capítulo 18 do Código Internacional de Produtos Químicos a Granel - IBC Code não se enquadram em nenhuma das categorias A, B, C ou D de que trata o artigo 4º da Lei nº 9.966, de 28 de abril de 2000.

Art. 4º Fica facultado ao Ibama, nos casos específicos que envolvam produtos formulados, classificá-los:

I- na mesma categoria de risco do componente mais nocivo do produto formulado avaliado; ou

II- em categoria resultante da avaliação de risco da mistura de substâncias nocivas, desde que atendida a exigência do art. 4º da Lei nº 9.966, de 2000 de se tratar de classificação tão completa e rigorosa quanto a estabelecida pela Marpol 73/78, fundamentada em critérios e métodos:

a) estabelecidos pelo "Group of Experts on the Scientific Aspects of Marine Environmental Protection" - GESAMP; ou constantes

b) no Sistema Globalmente Harmonizado de Classificação e Rotulagem de Produtos Químicos (GHS); ou

c) na Norma Brasileira ABNT NBR 14725-2 e suas atualizações.

Parágrafo único. Em todos os casos, será considerada a melhor informação técnica disponível no momento da avaliação.

Art. 5º A lista atualizada das substâncias nocivas ou perigosas classificadas nas categorias A, B, e D de que trata o artigo 4º da Lei nº 9.966, de 28 de abril de 2000 e as não nocivas classificadas na categoria OS de que trata do Capítulo 18 do IBC Code consta do anexo do presente ato.

Art. 6º Fica revogada a Instrução Normativa nº 06, de 06 de Julho de 2001.

Art. 7º Esta Instrução Normativa entra em vigor na data da sua publicação.
